CONDITIONS OF USE OF THE WEB OF LYDIA

* Acceptance of Terms
The general conditions described below govern the use of the Web LYDIA.
The use of the site LYDIA attributes the condition of user of the website LYDIA, and carries the full and unreserved acceptance of any kind, by the user, of all General Conditions which are published at the moment of the user access.
Therefore the user is advised to read the contents of the General Conditions every time he has to use the website.
* Use of Cookie Technology
LYDIA uses cookies when a user browses the web LYDIA. These cookies are only associated with an anonymous user and his computer and do not provide references in order to deduce the name of the user.
LYDIA's cookies cannot read data off your hard disk or read cookie files created by other service providers.
LYDIA encrypts the user identification data for added security. Through cookies, LYDIA can recognize registered users after they have registered for the first time, not to be recorded each time they visit the Web LYDIA.
The user can configure his browser to be notified on screen of reception of cookies and to prevent the installation of cookies on the hard disk.
For using the web LYDIA isn't necessary from the user to allow the installation of the cookies sent by LYDIA, but this situation will require the user to register every time they access a service that requires registration.

* No License
LYDIA doesn't grant any license or authorization of any kind on its intellectual property rights or any intellectual property or other right related to the web LYDIA, relative to Services or Content, except when expressly contracted or determined .
* Denial and withdrawal of access to the website and / or services
LYDIA reserves itself the right to refuse or withdraw access to its website at any time without prior notice to those users who violate these Terms or particular ones that may be applyed.
* Applicable Laws
These general conditions are governed by Spanish law.

LEGAL INFORMATION FOR DATA COLLECTION
Under the provisions of Article Five of Law 15/1999, we inform you that the data collected in these forms will be part of a data base, property of the company LYDIA MAYNE. The purpose of collecting information will be to manage their purchase orders, and conducting any business by the company.
Form fields marked as required are set to make a proper response and follow-up of orders as well as to process requests as registered client. If the user doesn't fill all the required information or fill it out inaccurate, he cannot use our electronic trading platform.

The request for registration as a customer and the allocation of the password for our client area does not imply the automatic assignment of a password, which will always be optional for the company. The company reserves the right to cancel without notice your password, and delete your request and our log file at any time.
Please note that the terms of use of the password by a customer are as follows:

* The user name or email address and password assigned to the user are personal and not transferable.
* The user agrees to diligently guard and keep his username and password.
* It shall be the responsibility of the registered user to provide due diligence to prevent access and / or use of the services provided by third parties who access or use his name or identified key codes.
* The user is solely responsible for the election, loss, theft or unauthorized use of any password or identification code and the consequences that may arise therefrom.

* The registered user may at any time unsubscribe immediately as user of the client area, by writing to our address or e-mail address lydiamayne@lydia.es, being identified as registered user with the password. That decision may not be retroactive.
User record in the customer area imply its express and unreserved acceptance of all conditions set out in the Legal Notice of the company LYDIA MAYNE.
The rights of access, rectification, cancellation and opposition to the personal data in our database shall be exercised by notice in writing to the attention of:

REGISTRATION PROCEDURE FOR CUSTOMER
The above registered customer expressly accepts the terms and conditions set out below:

* The client will solicit via the web form "REGISTER" his request for allocation of his username and password, the request may not be sent without reading and agreeing to the terms of use.
* The username is a valid email address in exclusive property of the client. The email address provided may be used by the company for commercial actions, if he request it explicitly. If he wishes to receive marketing information and unsubscribe later, the company has established a system that is easy to apply for the suspension until further request from him.
* Requests received by LYDIA MAYNE (or LYDIA) will be assessed, and verified its authenticity, by our staff. Accepted requests will be answered by the company via email to the supplied email address, with the terms of use, user name and password, along with all contractual conditions. The company may cancel its authorization and conditions at any time for any reason and without notice. Modifications to the terms of use, access and recruitment of electronic commerce will be reflected on our website; is responsibility of the customer to review and see them every time.
* When a request is received it implies express acceptance of the terms set by the company.

PURCHASING PROCESS IN OUR E-COMMERCE
The purchasing process using our e-commerce is set out below:

* Customer Login
The first requirement to be complied with by any non registered user of e-commerce offered by LYDIA on its website is to register as client to be able to use its services.
Through the REGISTER option, within the YOUR ACCOUNT section, customers must fill in all required data requested by LYDIA in order to be registered as a customer and enjoy its services.
It must provide identifying information, personal information, shipping information, method of payment and acceptance of contractual and privacy terms.
* Confirmation of clients registration
Once entered the customer identification data and accepted the terms by him, LYDIA proceed, after reviewing the data, to confirm the registration of the client by sending an email to the email address used by this identification key.
* Client ID
Once registered the customers in the e-commerce LYDIA, they must enter their email address and password in the ID option, within YOUR ACCOUNT, if they want to use its services.
* Articles showcase
The purchase process begins with the selection of articles by the customer, which are available on the homepage, divided by families (identified by a column of different rows, where each one includes a family that reveals the different products offered by LYDIA).
The showcase of products submitted by LYDIA MAYNE in different sections of its website, is subject to any changes or uncatalog of its products without notice, both features and prices; its presentation on our website does not imply the availability of the product for sale at any time. Specified information on the products presented on our website may be changed or eliminated at any time by the company, as well the company is not responsible for any inaccuracies, misspelled or graphic that can contain our website.
The images shown of the products don't have to match the actual item. The company offers our customers our sales department for any technical support on our website, and isn't responsible for the decisions that the client or consumer can take because of the brief information indicated about our products on our website.
Proposals for orders received by email are not considered contract until they are reviewed by the sales department and approved by the company, the purchasing process as detailed in this site.
Purchase orders can be made in any language, however the company will only formalize them in Spanish and French, beeing this document the valid one in case of disputes or discrepancies.
Orders not yet accepted by the company may be modified at any time by the client or by sending the changes to our sales department by email, fax or telephone. In the case of orders accepted, the company sets a deadline of 24 hours before delivery for modifications.
All documentation generated in the process will be saved by the company during the legal period established, and will be accessible to the consumer upon writen certified request to the registered office address of the company.
* Cart
The customer will be adding items to his shopping cart as he's selecting the icon represented by a cart that is included with the description and price of the product on the page that contains all products offered by LYDIA .

* Selecting items
Once articles are selected and the shopping made, the customer must confirm his order. Electronic commerce has an option to modify or cancel the proposed order.
* Order acknowledgement
The following option will allow the customer to gain access to the order form and order acknowledgement, where the customer has the possibility to check the details, modify them if wanted and to specify observations, as well as to confirm the order in the moment its information is considered as correct, in the order porposal form.
The order acknowledgement must be made through the option CONFIRM ORDER.

Confirmation of payment and address of the invoice.
* Sending the confirmation of the proposed order:
A first email will be sent to the customer, in which he'll be informed about his order details and the shipment information.

The order data is checked by the commercial department in LYDIA, and its validity is confirmed. This document will be considered as a contract for the purposes defined in Article 23 of Law 34/2002, the parties agree that the contract was occurred by the head office of the company.

If the customer agrees, he will proceed to the payment of the order and refer via fax the transfer to the company. If the customer had any discrepancies, he must contact the company commercial department for his claim.
All documentation generated in the process will be saved by the company during the legal established period, and will be accessible to the consumer upon certified request, writen, to the head office of the company.
* Checking the order payment
Once expired the date set by LYDIA for the settlement of the order, LYDIA shall check that the transfer has been completed.
If the payment has not been produced, LYDIA will consider the order as rejected.
In case the transfer is successfully processed, LYDIA will initiate procedures to send the request made by the customer in the shortest time possible.

INTELLECTUAL PROPERTY
All contents in Lydia.es are intellectual property of the company, and are protected according to the national intellectual property legislation and international laws. It is absolutely forbidden to use the content of our website without the written permission from the company. It is prohibited to establish this page as part of other, however it's allowed to make a link to our Internet address (URL of the web page) if they do not relate neither to false,nor inaccurate nor incorrect manifestations, which can induce confusion or mistake or that are contrary to law, morality or decency.

EXPENSES AND SHIPMENT
Custom costs are charged by the postal company (Correos), round about 10 Euros fixed by custom plus I.G.I.C. These estimated costs are not reckoned on the website and are always paid by the customer.
On shipments outside the European Union, shipping charges vary with weight; we recommend not to order extremely heavy or bulky items from these areas.
